JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-12-2021 Heard the learned counsel for the petitioner and Shri Vishwanath Prasad Sinha, the learned Senior counsel appearing for the Economic Offence Unit.

The petitioner seeks regular bail in connection with Economic Offences P.S. Case No. 30 of 2014 for the offence punishable under Sections 420, 406/34 of the Indian Penal Code.

The allegation against the petitioner is regarding taking money from the villagers on the pretext of erecting mobile tower, however, subsequently, neither the tower was erected nor the money was returned.

The learned counsel for the petitioner has submitted that though the petitioner had approached this Court earlier,

It is further submitted that the petitioner is languishing in custody since28.08.2019. The learned counsel for the petitioner has further submitted that similarly situated coaccused persons have already been granted bail by co-ordinate Benches of this Court. It is also submitted that one of the coaccused person was granted bail upon completion of six months custody by a co-ordinate Bench of this Court vide order dated 24.06.2015 passed in Cr. Misc. No. 18394 of 2015. Per contra, the learned Senior counsel for the Economic Offences Unit, Shri Vishwanath Prasad Sinha, assisted by Shri Vijay Anand, Advocate, by referring to the counter affidavit, has submitted that the allegations have been found to be proved and a charge sheet has already been submitted against all the accused persons including the petitioner herein, however, he has not disputed the fact that coaccused persons have already been granted bail by co-ordinate Benches of this Court.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the parties and taking into account the parity of the case of the petitioner with that of the co-accused persons, who have

Patna High Court CR. MISC. No.17233 of 2021(6) dt.06-12-2021 3/3 already been granted bail, I deem it fit and proper to direct for release of the petitioner on regular bail.

Accordingly, the petitioner, above named, is directed to be released on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Patna in connection with Economic Offences P.S. Case No. 30 of 2014 dated 14.07.2014.
