JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 30-06-2016 The petitioners apprehend their arrest in a case under section 406 of the Indian Penal Code and section 138 of the NI Act.

As per the complainant, the petitioners duped him of a sum of Rs.20 lacs on different occasions on false pretext of providing him a piece of land.

It appears that the main allegation is against Rajendra Sao, who is said to have taken the money from the complainant. Petitioners are son and wife of said Rajendra Sao. As per allegation, they merely kept the money in a bag which Rajendra Sah got from the complainant.

In the facts and circumstances of the case, in the event

No.24447 of 2016 (4) dt.30-06-2016 2/2 of arrest/surrender, let both the petitioners as mentioned in the cause title, be released on bail on their furnishing bail bond of Rs.5,000/- each with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Barh, Patna in Complaint Case no. 273(c ) of 2014.
