The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 354, 354-B, 504, 506 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is a person with one antecedent and the informant alleges that the petitioner tried to outrage the modesty of his daughter.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and the date of occurrence is 04.10.2022 and the FIR was instituted on 08.10.2022. It is next submitted that the supervising authority based on the investigation carried out has come to a conclusion

No.9341 of 2023(2) dt.07-07-2023 2/2 that victim was not a minor, as such, POCSO Act was not attracted, it is next submitted that the said fact has been specifically pleaded at Para 9 of the anticipatory bail application. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Palanwa P.S. Case No. 215 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

The learned counsel for the petitioner at the stage seeks permission to make rectification in the pleading at Para 3 of the anticipatory bail application.
