2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 103(1), 61(2) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act.
3. According to F.I.R., this petitioner along with other F.I.R. named accused persons committed murder of the husband of informant.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. As per F.I.R., petitioner is only alleged to be the conspirator and husband of the informant was killed by some unknown
Patna High Court CR. MISC. No.7326 of 2025(2) dt.03-03-2025 2/2 miscreants. There is no specific allegation of overt act against petitioner. Petitioner is lady and claims clean antecedent.
5. Learned A.P.P. for the State as well as learned counsel for the informant vehemently opposed the bail application.
6. Considering the nature of accusation and other facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of her arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in connection with Alamnagar P. S. Case No. 268 of 2024, subject to condition as laid down under Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita, 2023.
