Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 47A of the Excise Act.

It is alleged that from the shop of Kapileshwar Rai 87.480 liters of foreign and country made liquor were recovered.

It is submitted by the learned counsel for the petitioner that recovery is from the shop of Kapileshwar Rai and petitioner was his tenant. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

Let the learned court below consider the prayer for

Patna High Court Cr.Misc. No.38288 of 2015 (2) dt.24-09-2015 regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Excise Case C2A No. 15 of 2015, pending in the court of learned Chief Judicial Magistrate, Vaishali at Hajipur.

With the above observation this application is disposed of.
