ANJANA MISHRA ORAL ORDER 07-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in custody since 31.7.2013 in Chakia P.S.Case No.199/13 for, allegedly, having committed offence under Section 414 of I.P.C.

It is submitted on behalf of the petitioner that a truck was intercepted and caught and the petitioner was found to be fleeing away near the sugar factory from where the said truck was recovered. It is further submitted that neither the petitioner was recovered or arrested as one of the occupants of the truck nor was there any case stating that the said truck was stolen truck so as to invite the provision of Section 414 of the I.P.C. It is submitted that another similarly situated person named in the F.I.R.and taken

Patna High Court Cr.Misc. No.40634 of 2014 (3) dt.07-01-2015 2/2 into custody, namely Mithlesh Kumar, has been extended the privilege of regular bail by this Hon'ble Court vide order dated 18.4.2014 passed in Cr.Misc. No.7660 of 2014. Considering the aforementioned submissions and also the fact that the petitioner has been in custody since 31.7.2013, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran, Motihari, in Chakia P.S.
