JUSTICE SHIVAJI PANDEY ORAL ORDER 08-02-2019 Heard learned counsel for the Petitioner, learned counsel for the State and learned counsel for the Informant. In this case, the petitioner is seeking anticipatory bail in connection with Jaynagar P.S. Case No.207 of 2018, registered for the offence punishable under Sections 341, 342, 354(B), 34, 504 of the Indian Penal Code and Section 12 of POCSO Act.
Allegation has been made that the petitioner has brought the victim girl in a room on the plea that Madam is calling. When she entered into the room, then he started showing obscene photographs and video and ill treated her. Learned counsel for the petitioner submits that the occurrence is alleged to have taken place on 18.04.2018 and the
Patna High Court Cr.Misc. No.7048 of 2019(2) dt.08-02-2019 2/2 FIR was lodged against the petitioner on 27.04.2018 i.e. after 10 days of the occurrence.
In a normal circumstance, the parent does not rush to the police station if any incident takes place with the daughter. There may be some contradiction in the statement, but in fundamental, this Court does not find any contradiction in the statement.
Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within four weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
