ANSARI ORAL ORDER 20-01-2015 This is an application, made under Section 439 of the Code of Criminal Procedure, seeking bail for the accusedpetitioner, namely, Ajay Kumar, in connection with Parihar Police Station Case No. 100/2014, under Section 414/34 of the Indian Penal Code.
Perused the above application and materials on record.
Heard Mr. N. K. Agrawal, learned Senior Counsel for the petitioner, and Mr. Anil Kumar Singh No.1, learned Additional Public Prosecutor, appearing on behalf of the State.
Though there are incriminating materials against the accused petitioner and the charge sheet has been submitted on 09.09.2014, the fact remains that the accused has been in custody since 12.07.2014 on the ground that he
Patna High Court Cr.Misc. No.38633 of 2014 (3) dt.20-01-2015 2/2 had been found in possession of a stolen motorcycle. In view of the fact that charge sheet has been submitted and there is nothing on the record to show that release of the accused-petitioner will, at this stage, adversely affect his trial, it is hereby directed that the accused above-named shall be released on bail of Rs. 10,000/- with two sureties, each of the like amount, subject to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi.
In terms of the above directions, this bail application shall stand disposed of.
