The petitioner is apprehending his arrest in connection with Sour Bazar (Patarghat O.P.) P.S.Case no.289 of 2018 , registered for offences punishable under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act. Allegation against the petitioner is that he ordered; on that other co-accused persons fired on the informant causing injury on the leg.

Submission of the learned counsel for the petitioner is that she is only order giver.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within

Patna High Court Cr.Misc. No.6993 of 2019(2) dt.06-02-2019 2/2 a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Saharsa in connection with Sour Bazar (Patarghat O.P.) P.s.Case no.289 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid observation, this application is allowed.
