The petitioner has preferred this application for grant of regular bail in a case registered under sections 414 and 412 of the Indian Penal Code and sections 20 and 22 of the NDPS Act. As per allegations in the FIR, 1 kg. of ganja was recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession. He has been falsely implicated in the case. Even otherwise the quantity of 1 kg of ganja would fall under the category of small quantity. The petitioner is in custody since 1.9.2020 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the petitioner not having any criminal antecedent and having remained in custody for over 11 months, the Court directs the petitioner to be enlarged on bail in connection with Ahiyapur P.S. Case no. 713/2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, NDPS Act, Muzaffarpur.
