The petitioner apprehends his arrest in a case registered for the offence under Section 7 of the Essential Commodities Act.

It is alleged that this petitioner, who is P.D.S. dealer, is involved in distribution and defalcation of P.D.S. rice and wheat and is indulged in disposing of P.D.S. food items in black marketing.

It is submitted on behalf of petitioner that F.I.R. has been lodged in haste without proper enquiry due to personal grudge with this petitioner. Moreover, P.D.S. license of the petitioner has already been cancelled by the authority concerned. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.9448 of 2023(2) dt.25-04-2023 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Araria in connection with Bhargama P.S. Case No. 202 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
