In this case, the petitioner is seeking regular bail in connection with Bettiah Town P.S. Case No. 457 of 2022, registered for the offences punishable under Sections 143, 147, 148, 149, 341, 323, 353, 332, 333, 338, 435, 436, 307, 427, 504, 120(B), 395, 412 of the Indian Penal Code, Section 27 of the Arms Act and 3⁄4 of the Prevention of Damage to the Public Property Act. As per allegation, a mob of students had called strike for protesting against the Central Government Agniveer scheme. A number of students and other persons have become accused. The learned counsel for the petitioner has submitted that petitioner is under custody since 22.06.2022 and on similar allegation a number of accused persons have been granted bail by
Patna High Court CR. MISC. No.7015 of 2023(2) dt.11-05-2023 2/2 the coordinate Bench of this Court in Cr. Misc. No. 58028 of 2022 and Cr. Misc. No. 64277 of 2022. The petitioner was not arrested at the spot.
Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Bettiah, West Champaran in connection with Bettiah Town P.S. Case No. 457 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
