2. The present application has been preferred for the grant of following relief:
"For the issuance of a writ order of direction to the respondent to exclude the petitioner's land from Gazette notification Under Section 15(1) of the Bihar land Reforms (fixation of ceiling Area and Acquisition of Surplus land) Act 1961 (hereinafter referred as Act) issued under Signature of District Collector, Saharsa, where by petitioner 's land was included in a ceiling proceeding against the land holder Late Bhup

At the outset, learned State counsel has taken this Court to the counter affidavit of the Circle Officer, Sadar, Supaul with reference to paragraph no.8 according to which the petitioner's land (Plot No. 546) has not been declared surplus in Gazette notification dated 30.10.1987 and as such, he is not entitled for the relief.
4. Learned counsel for the petitioner submits that if such averments have come form the respondent, he is content with that.
5. In that background, he prays for withdrawal of the petition, the writ petition stands disposed of. (Rajiv Roy, J) vinayak/- U
