2. The petitioner apprehends his arrest in a case registered for the offence under Section of the Indian Penal Code.

3. As per the prosecution case, on 18.09.2023 at around 11:00 AM, this petitioner and his bodyguard assaulted son of informant and as such, feeling humiliated from the beatings of this petitioner, he (son of informant) committed suicide.

4. Learned counsel for the petitioner submits that in

Patna High Court CR. MISC. No.5994 of 2025(2) dt.27-02-2025 2/3 this case, complaint was lodged on 07.10.2023 i.e. after an inordinate delay of 19 days and there is no plausible explanation of delay. Thereafter, F.I.R. has been lodged after one year on 02.11.2024. As a matter of fact, son of informant committed suicide on 18.09.2023, for which, U.D. Case No. 01 of 2023 was registered (Annexure P/2) and thereafter, inquest report was also prepared. Fardbeyan of wife of deceased was also recorded on the same date i.e. on 18.09.2023, but in her fardbeyan, she did not whisper anything against this petitioner and thereafter, this false and concocted case has been lodged only with a view to harass this petitioner. There is no allegation of any direct or active role, which compelled the deceased to commit suicide. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate - I, Kaimur (Bhabua) in connection with Lohara P.S. Case No. 09 of

Patna High Court CR. MISC. No.5994 of 2025(2) dt.27-02-2025 3/3 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
