2. The present petition has been preferred for the following relief/s:
(i) for issuance of an appropriate writ commanding the respondents specially the respondent nos.5 and 6 namely the District Land Acquisition Officer, Aurangabad and the Competent Authority-cum-Deputy Collector Land Reforms, Aurangabad
Patna High Court CWJC No.10380 of 2017(2) dt.21-04-2025 2/3 (Bihar) to decide the objection of the petitioner, submitted on 11.02.2011 pursuant to the notification issued under section 3A(1) of the National Highways Act, 1956, published in the local newspaper "Dainik Jagran" on 02.02.2011;
(ii) for issuance of an appropriate writ, commanding the respondent especially the respondent no.6 the Competent Authoritycum-Deputy Collector Land Reforms, Aurangabad (Bihar) to look into the matter and decide the objection and consequent thereto pay compensation to the petitioner with respect to land of Plot no.764 having an area 0.37 dec.;
(iii) for any other relief/reliefs for which the petitioner is entitled under the law as well as on facts.
3. A counter affidavit has come on behalf of respondent nos. 4 to 6 duly signed by the Dy. Collector, Land Reforms, Aurangabad.
4. Learned counsel for the petitioner submits that in
Patna High Court CWJC No.10380 of 2017(2) dt.21-04-2025 3/3 the light of statement made by the respondents in the counter affidavit, the respondent no.6, Dy. Collector, Land Reforms, Aurangabad has to decide the matter, if still not decided.
5. Learned State Counsel concurs to the said submission.
6. In that background, the writ petition stands disposed of with a direction to the aforesaid respondents that in the light of the statement made in para-11 of the counter affidavit, if the same has still not been decided, to conclude and dispose of it in next three months.
7. The writ petition stands disposed of.
