Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner was working as Panchayat Secretary at the relevant time and accusation against him is that he misappropriated government money, which was meant for diesel subsidy scheme.
Learned counsel for the petitioner submits that in the light of order dated 19-11-2014, the petitioner furnished the relevant documents to the I.O. It is further contended by him that moreover, from perusal of order of learned Additional Sessions
Patna High Court Cr.Misc. No.38364 of 2014 (3) dt.09-02-2015 2/2 Judge, it would appear that the amount could have been withdrawn by the joint signature of the petitioner and concerned Mukhiya but it is surprisingly enough that the concerned Mukhiya has not been made accused in this case and the entire responsibility has been thrown upon the shoulder of the petitioner.
Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Dumariyaghat P.S. Case No. 60 of 2012 to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran.
