The petitioner seeks bail in Korha P.S. Case No. 561 of 2020, registered for the offence punishable under Sections 363, 366(A) of the Indian Penal Code and section 4 of the POCSO Act.

As per the prosecution case, petitioner kidnapped the daughter of informant and kept her in his house. It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. In fact, there was love affair between the petitioner and the victim girl. The victim girl in her statement under Section 164 Cr.P.C has clearly stated that out of her own sweet will she went along with this petitioner solemnized marriage with him and she disclosed her age to be 20 years. In view of the statement of victim girl under Section 164 Cr.P.C, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge VII, Katihar in connection with Korha P.S.
