The petitioner, being the husband of the complainant is languishing in custody since 04.01.2019 in a complaint case wherein process has been directed to be issued after cognizance

Patna High Court Cr.Misc. No.10049 of 2019(2) dt.20-02-2019 2/3 being taken for the offences punishable under Sections 323, 379 and 498A of the Indian Penal Code and under Sections 3 and 4 of the Dowry Prohibition Act.

The prosecution case, as per the complaint petition is that the marriage between the complainant and the petitioner was performed on 16.11.2016 but subsequently, further dowry demand of a motorcycle and Rs. 3,00,000/- cash was made and due to non-fulfillment of the same, torture was inflicted upon the complainant. It is further alleged that on 20.12.2017, after snatching all the belongings of the complainant, she was driven out from her matrimonial house.

It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the complainant. It is further submitted that earlier the petitioner was granted provisional bail by the learned Court below with a condition to produce marriage certificate but he failed to produce the same before the learned Court below, as a result, the provisional bail of the petitioner got cancelled.

It is submitted by the learned APP for the State that there is specific accusation of torture against the petitioner. Considering the nature of accusation and period under custody, let the above named petitioner be released on bail on
