JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 12-12-2022 Heard learned counsel for the petitioner and Mr. Harshvardhan Shiv Sundaram, learned AC to SC-8 for the State. The petitioner in the present case is seeking following reliefs:- "A. For the issuance of an appropriate writ/writs for direction to the concern respondent authority specially respondent no. 3 and 4 for the protection of life and property to the petitioner who is a 74 years old widow lady, continuously subject to harassment & criminal atrocity by the act of private respondents against whom complaint dated

Patna High Court CR. WJC No.144 of 2022(8) dt.12-12-2022 2/2 07-06-2021 (Annexure-1) was filed before respondent no. 3 and 5 under Rule-22 of the Bihar Maintenance & Welfare of Parents & Senior Citizens Rule, 2012 and another complaint dated 07-06-2021 (Annexure-2) under Section 5 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 which was registered as izdj.k dzekad 01/2021-22, both the complaint are pending for disposal till date.

B. For direction to respondent no. 6 to 9 to keep petitioner at her home in a dignified manner and not harass and assault on her. And for any other relief/reliefs for which the petitioner is found to be entitled under the provision of law involved in the present case."

Having regard to the submission made in paragraph '25' of the counter affidavit filed on behalf of respondent nos. 3 and 5 wherein it is stated that during enquiry, the petitioner requested the police officers not to take any legal action against her sons because they were taking proper care of her, at this stage, this Court finds no reason to proceed with this writ application.

This application has become infructuous. It is expected that the petitioner who is an old age lady will be taken care of.
