In this case, the petitioners are seeking regular bail in connection with Gopalpur P.S. Case No.53 of 2013 registered for offence punishable under section 147, 148, 149, 342, 452, 323, 324, 307, 109, 353, 332, 333, 379, 380, 337, 338, 435, 436, 427 and 120(B) of the Indian Penal Code.

An FIR has been lodged against the petitioners and large number of persons making allegation that large number of persons have been entered into the police premises, indulged in brick-batting, damaged the vehicle and put the police station under fire.

No.8254 of 2020(3) dt.03-06-2020 2/2 Learned counsel for the petitioners submits that the from the FIR it appears that the body of the victim was brought in the private ambulance and thereafter, mob reached there and they put the fire but the fact is that the victim was being taken to the hospital and the police did not allow and ultimately the victim died. He further submits that it is a matter of 2013 and the petitioners have been arrested in the year 2019, inasmuch as there is no specific allegation against them. Looking to the fact and circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Gopalpur P.S.

Case No.53 of 2013, subject to the condition that one of the bailors of the petitioners shall be close relative. The petitioners will not induce any witness or tamper with the evidence. The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court.
