The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per allegation in the FIR, 51.75 litres of liquor was recovered from the car.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession. The car in question does not belong to the petitioner. He is in custody since 7.9.2020 and has no criminal antecedent. Heard learned APP for the State.

Having heard learned counsel for the parties and

Patna High Court CR. MISC. No.17400 of 2021(2) dt.13-08-2021 2/2 taking into consideration the petitioner not having any criminal antecedent and having remained in custody for more than 11 months, the Court directs the petitioner to be enlarged on bail in connection with Excise Complaint Case no. 72 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II, Banka.
