JUSTICE AHSANUDDIN AMANULLAH ORAL JUDGMENT Date: 03-02-2017 The petitioner had moved this Court for a direction to recount the valid votes for the post of Mukhiya of Khabdah Panchayat No. 23 under Narpatganj Block in the District of Araria which, according to her, had wrongly been counted in favour of respondent no. 7.
Learned counsel for the petitioner at the very out set submitted that he has already filed election petition no. 07 of 2016 before the Munsif, Araria. He submitted that the matter relating to
Patna High Court CWJC No.10514 of 2016 dt.03-02-2017 2/2 election, time being of essence, the election petition be directed to be disposed off expeditiously.
Learned counsel for the State Election Commission does not oppose.
Accordingly, the writ petition stands disposed off with direction to the concerned Munisf, Araria to hear and decide the Election Petition No. 07 of 2016 relating to election in question, expeditiously and in any case within a maximum period of six months from the date of production of a copy of this order before him. Even if the parties do not cooperate, the Court shall proceed and decide the matter finally within the time stipulated in this order, in accordance with law.
