The petitioner seeks bail in a case registered for the offences punishable under sections 302, 201/34 of the Indian Penal Code and section 27 of the Arms Act.

The petitioner is of course named in the F.I.R. but no specific allegation is made against the petitioner. Specific allegation is made against Umesh Choudhary and English Choudhary that they fired causing death of Jato Rai on the spot. Similarly situated co-accused Sajo Choudhary has already been enlarged on bail vide order passed in Criminal misc. No. 2660 of 2012.

Considering the facts aforesaid, the petitioner above named, is directed to be enlarged on bail on furnishing bail

Patna High Court Cr.Misc. No.39899 of 2015 (2) dt.31-08-2015 bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri D. Kumar, Judicial Magistrate, 1st Class, Saharsa in connection with Salkhua P.S. Case No. 103 of 2003.
