The petitioner apprehends his arrest in connection with Gaighat P.S. Case No. 242 of 2020 registered under Sections 272 and 273 of the I.P.C. and Section 30(a), 41(i) of the Bihar Prohibition and Excise Act.

Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case. Further submission is that petitioner has no concern with the alleged recovery.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that from perusal of seizure list, it appears that the alleged illegal foreign

Patna High Court CR. MISC. No.16769 of 2021(3) dt.11-01-2022 2/2 liquor has been recovered from the residential house of this petitioner. Hence, this is not a fit case for anticipatory bail. Having considered the facts and circumstances of the case and the submission advanced on behalf of the State, this Court is not inclined to grant anticipatory bail to the petitioner.
