====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 27-04-2018 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking anticipatory bail in connection with CBI/ACB Case No. RC0232015A0001/2015, RC Case No.1A/2015, registered for the offence punishable under Sections 120-B read with Section 420, 467 and 468 of the Indian Penal Code and under Section 13(2) read with Section 13(1)(d) of the Prevention of Corruption Act.

Allegation has been made against the petitioner that he has obtained the service of Gramin Dak Sevak (G.D.S.) on the basis of forged certificate.

Learned counsel for the petitioner submits that other co-accused persons have been granted bail by this Court in

Patna High Court Cr.Misc. No.22935 of 2018(2) dt.27-04-2018 2/2 Criminal Miscellanous Nos. 57203 of 2017, 49549 of 2017, 47268 of 2017, 49588 of 2017, 38547 of 2017, 39977 of 2017, 32417 of 2017 and 49364 of 2017.

Looking to the entire facts and circumstances of the case, let the petitioner, namely, Binod Kumar, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Special Judge, C.B.I. Court-II, Patna, in connection with CBI/ACB Case No. RC0232015A0001/2015, RC Case No.1A/2015, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. Further condition is that whenever the police will call the petitioner for the purposes of investigation and interrogation, he will remain present for the investigation. In the event of being absent on two consecutive dates without reasonable explanation, the present order will be treated to have been cancelled. (Shivaji Pandey, J) pawan/- U T
