The petitioner seeks bail in a case registered under Sections 498, 306/34 of the Indian Penal Code. Allegation against the petitioner is of committing torture upon the victim due to non-fulfillment of demand of dowry and in consequence thereof, being fed up from the ill attitude of inlaws people, the victim with her baby committed suicide putting themselves before a running train.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 22-09-2018. The petitioner has falsely been implicated in the present case due to petty family

Patna High Court CR. MISC. No.8361 of 2019(3) dt.09-04-2019 2/2 dispute. There is no other substantive evidence to suggest the implication of the petitioner in the present case. He has remained in custody for more than six months. There is no eye witness to the alleged occurrence.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate (Railway), Saran at Chapra in connection with Chapra Rail P.S.
