No doubt, informant is said to be minor but she admits in her written report that she was fallen in love with the petitioner and thereafter, petitioner established physical relation forcibly on false promise of marrying her but subsequently, when she became pregnant, he refused to solemnize marriage with her.
Learned counsel for the petitioner submits that the petitioner was aged about 19 years at the time of alleged occurrence and, as a matter of fact, informant was also major. It is further contended by him that moreover, after institution of the present case, both parties have compromised the case and, therefore, with an intent to save the future of both parties, this court may take lenient view. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on
Patna High Court Cr.Misc. No.38140 of 2015 (3) dt.05-11-2015 furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge I, Supaul in POSCO case no. 17/2015 arising out of Mahila P.S. Case no. 38/2015.
