JUSTICE MUNGESHWAR SAHOO ORAL ORDER 10-03-2015 From perusal of the record, it appears that the learned counsel, who was appearing on behalf of the appellant, has joined the judicial service and now became the sitting Judge of Jharkhand High Court, Ranchi.

Notices were issued directly to the appellant for engaging another advocate. The notice has already been validly served on the appellant but the order directing the appellant to issue notice on the sole respondent has not been complied with. It further appears that when the order is not complied with, again two weeks time was granted to the appellant by terms of order dated 16.02.2015 but still today the order has not been complied with. Therefore, the appeal is dismissed against the sole respondent.

Since there is no other respondent as the name of other respondent has already been deleted, this first appeal has become

Patna High Court FA No.799 of 1989 (21) dt.10-03-2015 now incompetent to proceed. Accordingly, this first appeal is dismissed as incompetent.
