JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2020 The petitioner seeks regular bail in connection with Kudhani P.S. Case No. 420 of 2019, registered for offences punishable under Sections 392 and 328 of the Indian Penal Code.
Prosecution case is that Tata 407 vehicle of the informant was intercepted by some miscreants and they after pulling the driver out of the vehicle and took away the vehicle loaded with iron rod.
It has been submitted on behalf of the petitioner that he is not named in the F.I.R., he has been made accused in this case on confession of co-accused and except that there is nothing against the petitioner and he has been in custody since 30.09.2019 and the co-accued, on whose, confession name of the petitioner transpired has already been enlarged on bail by a
Patna High Court CR. MISC. No.5000 of 2020(2) dt.31-01-2020 2/2 coordinate Bench of this Court vide order dated 16.12.2019 passed in Cr. Misc. No. 83458 of 2019.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -III, Muzaffarpur, in connection with Kudhani P.S. Case No. 420 of 2019, subject to the condition that petitioner has to appear before the Officerin-Charge of the police station of his area in the second week of each month for a period of six months so that the police may watch his conduct during that period.
