JUSTICE SANDEEP KUMAR ORAL ORDER 16-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Purnahiya P.S. Case No. 173 of 2022, registered for the offence punishable under Sections 20/22 of the N.D.P.S. Act. Learned counsel for the petitioner submits that the petitioner is innocent and falsely been implicated in this case. There is general and omnibus allegation against the petitioner.. Petitioner is in custody since 06.11.2022.

Learned APP has vehemently opposed the prayer for bail.

Considering the fact that small quantity of ganja has been recovered which is punishable by one year, his period of custody, this application is allowed.
