The petitioner seeks bail in a case under Section 406, 409, 420 of the Indian Penal Code.

Nirmala Devi, the mother of the petitioner, is owner of Om Shiv Shakti Rice Mill, Mokma, Dhamdaha. She lifted 773.301 Metric Ton paddy and she had to deliver 528.112 Metric Ton rice. 464.11 Metric Ton of rice is still lying due against mother of the petitioner. The petitioner is not even named in the FIR. Certificate case is also going on. Immovable property of the owner of the rice mill is also pledged.

Considering the facts aforesaid and the fact that petitioner did not lift any paddy, the above named petitioner is

Patna High Court Cr.Misc. No.40751 of 2015 (2) dt.08-09-2015 2/2 directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in Dhamdaha P.S. Case No. 89 of 2015.
