The petitioner seeks regular bail in connection with Bairganiya P.S. Case No. 251 of 2021 lodged under Section 30(a) of Bihar Prohibition and Excise (Amendment) Act. As per the allegation made in the F.I.R., the total recovery of 80 liters of Nepali wine has been made in the present case.

Learned counsel for the petitioner submits that charge sheet has already been filed in this case and petitioner is in custody since 08.12.2021 having clean antecedent. He further submits that other co-accused persons have been granted bail by the Co-ordinate Bench of this Court. He also submits that recovery of the alleged wine has not been made from conscious

Learned A.P.P. has opposed the prayer for bail. Considering the facts that charge sheet has been filed in this case and petitioner is in custody since 08.12.2021 having no criminal antecedent as well as the Co-ordinate Bench of this Court has already been granted bail to accused Sandeep Das vide order dt. 07.06.2022 passed in Cr. Misc. No.2528 of 2022, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Court-I, Sitamarhi in connection with Bairgania P.S. Case No.251 of 2021.
