This application has been filed for modification of the order dated 29.02.2020 passed by this court in Cr. Misc. No. 4821/ 2020 for extension of period of surrender of the
Patna High Court CR. MISC. No.12913 of 2023(3) dt.29-03-2023 2/2 petitioners before the court below.
Learned counsel for the petitioners submits that earlier petitioners were granted anticipatory bail by order dated 29.02.2020 passed in Cr. Misc. No. 4821/ 2020, whereby petitioners were directed to surrender before the court below within a period of twelve weeks from the date of receipt/ production of a copy of the order, but the petitioner could not surrender within time due to COVID-19 Pandemic and lockdown.
It appears that petitioners were granted anticipatory bail in the year 2020 but this modification application has been filed in the year 2023, that is, after three years of granting anticipatory bail and on this ground alone, I am not inclined to modify the order dated 29.02.2020 passed in Cr. Misc. No. 4821/ 2020.
This modification petition is, accordingly, dismissed. (Prabhat Kumar Singh, J) BKS/- U T
