Petitioner is named in the first information report but according to prosecution case itself, it was co-accused Bramhdeo Yadav, who gave fatal blow to the deceased. So far as petitioner is concerned, it is only stated that he along with other co-accused assaulted the informant with lathi but it is not clear from the first information report as well as impugned order as to whether informant got any treatment or not.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named,

Patna High Court Cr.Misc. No.39226 of 2015 (2) dt.09-09-2015 2/2 be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Supaul in connection with Chattapur P.S.Case No. 92 of 2015.
