JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier prayer for bail of the petitioner was rejected by this court taking note of this fact that petitioner was caught on the spot but submission on behalf of the petitioner is that petitioner is in jail custody since 03-01-2014 and uptill now, his trial could not commence.

Learned court below has reported that out of 15 accused, two accused are still absconding and the matter is pending for supply of police paper.

Regard being had to the facts and circumstances of the case as well as submission of the parties, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in

Patna High Court Cr.Misc. No.37337 of 2015 (3) dt.16-12-2015 2/2 connection with Trial No. 3523 of 2015 arising out of Turkaulia P.S. Case No. 04 of 2014 pending in the court of Sri Dwijendra Kumar, learned Judicial Magistrate-Ist Class, Motihari, East Champaran stands rejected.

However, learned court below should expedite the commitment of case of the petitioner in accordance with law, even by separating his case from the case of absconding accused persons.
