The petitioner seeks bail in anticipation of his arrest in connection with Kadamkuan P.S. Case No. 96 of 2020 dated 24.02.2020 instituted for the offence under Section 366 of the Indian Penal Code.

Though the petitioner has not been named in the FIR but the victim in her 164 Cr. P.C. statement has said that she had some acquaintance with the petitioner, who took her to different destinations and forcibly married her by putting vermilion on her head. Later, she learnt that the petitioner was a married person with two kids.

Considering the afore-noted accusation in the 164 Cr.P.C. statement of the victim girl, I am not inclined to grant

Patna High Court CR. MISC. No.17156 of 2021(5) dt.26-04-2022 2/2 anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail is rejected.

However, if the petitioner surrenders before the court below and seeks bail, his application shall be considered on its own merits without being prejudiced by the fact that the present petition on his behalf has not been entertained. (Ashutosh Kumar, J) krishna/- U T
