Mr.Rajesh Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 01-02-2021 Heard learned counsel for the petitioner and the State. The petitioner being the husband is apprehending his arrest in a case registered for the offences punishable under Sections 498A/34 of the IPC.

Allegation against the petitioner is of torturing the Informant along with FIR named accused for non fulfillment of demand of dowry.

Learned counsel for the petitioner submits that the petitioner admits his marriage with informant and he is ready to keep the informant as wife with full dignity and honour, statement to that effect has been made in paragraph no. 9 of the petition.

Considering the present stand of the petitioner, let the

No.6670 of 2020(5) dt.01-02-2021 2/2 petitioner named above be released on provisional bail, in the event of his/her arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bond of Rs. 20,000/-with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Dulhin Bazar P.S. Case No. 243 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

Let the learned Court below issue notice to the informant and on her appearance, the petitioner will take the informant to keep her as wife with full dignity and honour. The provisional bail of the petitioner will be confirmed by the learned Court below in three eventualities, (i) if the conjugal life substantially resumes, or (ii) if the informant fails to appear before the learned Court below, or (iii) if the informant deliberately gets reluctant to reconcile the issue.
