Petitioner seeks bail in connection with Muffasil (Samastipur) P.S. Case No. 94/2019 registered for the offences punishable under Sections 30(a), 32(2) of the Bihar Prohibition and Excise Act, 2016.

Admittedly, neither the petitioner was caught on the spot nor anything was recovered from his conscious possession and the name of the petitioner came in this case on confessional statements of co-accused who were caught on the stop. Moreover, co-accused has already been granted privilege of bail by a co-ordinate Bench of this Court.

No.6804 of 2020(3) dt.13-05-2020 2/2 Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Samastipur/concerned court in connection with Muffasil (Samastipur) P.S. Case No. 94/2019.

However, it is made clear that if the petitioner fails to make available sureties due to lock down as well as due to prevailing situation, the concerned court shall release the petitioner provisionally on personal bond with condition that petitioner shall furnish the sureties when lock down is over.
