Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is languishing in custody for the offences punishable under Sections 399/402/414/34 of the Indian Penal Code and Sections 25(1-b)a/26/35 of the Arms Act. A loaded country-made pistol and cartridges were allegedly recovered from the possession of the petitioner besides recovery of fire-arm from the other co-accused at the same time. The petitioner has got one identical criminal case. The petitioner is in custody since 30.08.2019.
After hearing the parties and considering the entire
Patna High Court CR. MISC. No.5432 of 2020(5) dt.05-10-2020 2/2 facts of this case including the fact that some other co-accused have been allowed bail by a coordinate Bench of this Court, let the petitioner, above named, be released on bail after framing of the charges on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Harsidhi P.S. Case No.305 of 2019, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
