This is the third attempt for grant of regular bail on behalf of the petitioner inasmuch as earlier on two occasions, the bail application of the petitioner was dismissed vide order dated 16.10.2020 passed in Cr. Misc. No. 22986/2020 and vide order dated 29.09.2021 passed in Cr. Misc. No.40606/2021 respectively.
This Court vide order dated 23.02.2022 had called for a report from the court of learned Additional Sessions Judge- X, Bhagalpur regarding stage of the trial and in pursuance thereof, the report vide Letter No. 22/2022 dated 04.03.2022 has been received and from perusal of the same, it would be evident that
Patna High Court CR. MISC. No.6911 of 2022(3) dt.30-03-2022 2/2 out of nine charge-sheet witnesses two witnesses are yet to be examined and further the learned trial court has given estimated time for conclusion of the trial within three months. In view of the report of the trial court that the trial of this case is likely to be concluded within three months, I am not inclined to granted bail to the petitioner at this stage. Accordingly, the same is dismissed.
However, petitioner, if so advised, may renew his prayer for bail after three months from today if the trial does not register any progress.
