The petitioner is languishing in custody for the offences punishable under Section 414 of the I.P.C. and Sections 8/20 (b) (ii) (B) of the N.D.P.S. Act.

3 kg. of Ganja was recovered from the motorcycle of the petitioner. Petitioner has stated on oath that he has got no criminal antecedent. Petitioner is in custody since 19.10.2020. Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail. Hence, prayer for bail is refused in connection with Sonbarsa P.S. Case No. 210 of 2020 pending in the court of learned Special Judge, Sitamarhi. However, the petitioner would be at liberty to renew the prayer, if the trial is not concluded within nine months.
