Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends her arrest for the offences alleged under Sections 147, 148, 149, 341, 323, 324, 307, 302 and 504 of the Indian Penal Code, registered in connection with Bhagwan Bazar P.S.Case No. 534 of 2019. As per allegation, the accused persons assaulted the family members of the informant. The allegation against coaccused Golu Rai is that he inflicted repeated knife blows on the person of the deceased Jitendra Yadav. The allegation against the present petitioner is that she assaulted the deceased and his father with fists and legs.

The learned counsel for the petitioner has submitted that she is a lady and there is only allegation of assault by fists and blows to the father of the informant.

From the injury report of Ram Snehi Rai, it appears

Patna High Court CR. MISC. No.16620 of 2021(4) dt.09-03-2022 2/2 that he has sustained simple injury. The main allegation of inflicting knife blow is on accused Golu Rai and not on the petitioner.

Considering the above facts and circumstances as well as the clean antecedents of the petitioner, let the petitioner above-named, in the event of her arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Bhagwan Bazar P.S.Case No. 534 of 2019, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
