The petitioner seeks regular bail in connection with Ahiyapur P.S. Case No. 478 of 2021 instituted for the offences punishable under Sections 399, 402 and 34 of the Indian Penal Code, under Sections 25 (1-b)a, 26 and 35 of the Arms Act and under Sections 8, 20(b)(ii)(B) of the NDPS Act. Learned counsel for the petitioner submits that the petitioner is in custody since 21.07.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that allegation is recovery of motorcycle bearing Registration No. BR06BZ-2162 was recovered from the possession of the petitioner and as far as recovery of arms and Charas are concerned, the same is from other named accused persons.

He has falsely been implicated in this case and no incriminating articles have been recovered from his possession. The said motorcycle stands in the name of his father. It is further submitted that another co-accused namely, Mithilesh Rajak has been granted bail by a Co-ordinate Bench of this Court vide order dated 02.03.2022 passed in Cr. Misc. No. 57218 of 2021. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 21.07.2021, charge-sheet has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judge, Muzaffarpur in connection with Ahiyapur P.S. Case No. 478/2021.
