The petitioner seeks bail in connection with Piprakothi P.S. Case No. 215 of 2022 registered for the offences punishable under Sections 328, 420, 392 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is in custody since 25.09.2022.

The allegation against the petitioner is of committing robbery along with other co-accused persons and while committing robbery, it is alleged that they took away the truck of the informant loaded with 1500

Learned counsel for the petitioner submits that the F.I.R. was instituted against unknown, subsequently, the truck of the informant was found and from the truck, it was found that 519 containers of palm oil was missing and rest of the palm oil was in the truck itself.

Learned counsel for the petitioner next submits that the name of the petitioner transpired in the confessional statement of co-accused Ranjan Kumar which does not have any evidentiary value, it is next submitted that Ranjan Kumar has already been granted regular bail by order dated 25.02.2023 in Criminal Miscellaneous No. 66679 of 2022 by the learned Co-ordinate Bench.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with

Accordingly, the present bail application stands allowed.
