The petitioner is in custody in connection with Kudra P.S. Case No. 69 of 2015 for the offence under Sections 409 and 420 of the Indian Penal Code.

On 28.05.2020, at the request of the counsel for the Bihar State Food Corporation, two weeks' time was granted to file counter affidavit, but no counter affidavit has been filed. Learned counsel for the petitioner submits that with the similar allegation, different F.I.Rs. have been lodged, in which the petitioner has been granted bail. He further submits that the allegation against the petitioner is that he issued a

Patna High Court CR. MISC. No.5796 of 2020(4) dt.02-07-2020 2/2 certificate of valuation of the property of accused Ram Kumar Singh on the basis of report of Halka Karamchari. The petitioner is in custody since 08.11.2019.

Considering the fact that in similar facts situation, other Courts have been granted bail to the petitioner, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.1,00,000/- (Rupees one lakh) with two sureties of the like amount each to the satisfaction of Special Court of Rice Miller, Gaya in connection with Kudra P.S. Case No. 69 of 2015 with the condition that both the bailors should be the Government employee.
