The petitioners apprehend their arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code.
As per the prosecution case, the F.I.R. named accused including this petitioner alongwith 4-5 unknown persons, variously armed, came at the house of informant and assaulted him, due to which, he sustained injury over his scalp. It is further alleged that when mother, son and wife of informant came to rescue, the accused persons also assaulted them and took away Rs. 25,000/- cash and other valuable ornaments.
Patna High Court CR. MISC. No.8096 of 2022(2) dt.02-08-2022 2/2 It is submitted on behalf of petitioners that both parties are pattidars and present case is outcome of old animosity and grudge. There is case and counter case. Injuries sustained by the injured are simple in nature. Petitioners have clean antecedent.
Learned A.P.P. for the State has opposed the bail petition.
Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Mahnar P.S. Case No. 25 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
