The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 326, 120B and 448/34 of the Indian Penal Code. While the informant was sleeping in the night, the petitioner along with co-accused Prince Tiwary, came to the informant and Prince Tiwary gave knife blow on the neck of the informant causing severe injuries to him.

It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case. The allegation levelled against the petitioner is not specific rather general and

Patna High Court CR. MISC. No.9072 of 2023(2) dt.18-04-2023 2/2 omnibus in nature, rather the specific allegation is agaisnt the co-accused Prince Tiwary of giving knife blow to the informant. It is further submitted that the brother of the petitioner had already lodged a case against the son of the informant and others vide Madhuban P.S. Case No.48 of 2008 in which trial is going on and only to make pressure on the petitioner and others the present case has been lodged by the informant. Petitioner has one criminal antecedent as mentioned in para-3 of this application.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Madhuban P.S. Case No. 265 of 2021, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
