The present application has been filed for modification of the order dated 24.09.2019 passed in Cr. Misc. No. 58778 of 2019 to the extent that the time granted by this Court for depositing a sum of Rs. 02 lakhs be extended further by two weeks.

Learned counsel for the petitioners submits that by order dated 24.09.2019 this Hon'ble Court was pleased to direct the petitioners to deposit a sum of Rs. 02 lakhs before the learned court below and to furnish bail bond within a period of

No.7252 of 2020(2) dt.05-02-2020 2/2 four weeks, however, a sum of Rs. 01 lakh has already been deposited by the petitioners on 03.10.2019 before the Civil Court, Bhagalpur but due to some unavoidable reasons the balance amount could not be deposited within time, which learned counsel for the petitioners submits will be deposited within a period of two weeks if the order dated 24.09.2019 is modified.

Having heard learned counsel for the parties and taking into consideration the submissions made by learned counsel for the petitioners, I am inclined to modify the order dated 24.09.2019 to the extent that let petitioners be permitted to deposit the balance amount of a sum of Rs. 01 lakh within a period two weeks from the date of receipt of a copy of this order.
