JUSTICE RAJEEV RANJAN PRASAD ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 20-07-2018 Petitioner claims to be the owner of a Bus bearing Registration No. BHF 8321 and it is said that registration of the vehicle was cancelled some time in the year 2009 vide Annexure 1 and challenging the cancellation, a representation was submitted before the competent authority vide annexure 5 and the same is pending since 09.11.2009 and the grievance put forth before us is that the District Transport Officer, Muzaffarpur, respondent No. 3, has not taken any action on the application.

If that be so, we direct the respondent No. 3, District Transport Officer, Muzaffarpur, to consider the representation of

Patna High Court CWJC No.758 of 2018 dt.20-07-2018 2/2 the petitioner dated 09.11.2009 and subsequent reminders submitted and pass a detailed order on the same within a period of 45 days from the date of receipt/ production of a copy of this order.

Needless to emphasize that we have not expressed any opinion on the merits of the claim of the petitioner and it is exclusively for the authority to deal with the issue in question, including the aspect of delay, if any, in the matter.
