2. The petitioner apprehends arrest in connection with in a case registered under Section 30(a) of Bihar Excise Act.
3. As per the prosecution case, 5 bottles of illicit liquor containing 750 ml were recovered near the motorcycle of this petitioner.
4. Learned counsel for the petitioners submits that petitioner is innocent and has falsely been implicated in this case only on the basis that the illicit liquor was recovered near the motorcycle of the petitioner. Further submission is that petitioner has no concern with the seized liquor. He was not apprehended on the spot. No incriminating article has been recovered from the conscious possession of the petitioner.
Patna High Court CR. MISC. No.14618 of 2025(2) dt.28-03-2025 2/2 Petitioner has no criminal antecedent and he undertakes to cooperate in the investigation and trial.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount to each to the satisfaction of the learned Sessions Judge, Excise-I, Patna in connection with Buddha Colony P.S. Case No. 163 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
